General Terms and Conditions (GTC)

world4europe Personalvermittlung GmbH

  1. Scope of Application

    These General Terms and Conditions apply to all contractual relationships between world4europe Personalvermittlung GmbH (hereinafter “world4europe”) and its clients in connection with the recruitment, consulting, and support of skilled workers and employees — particularly from third countries — for employment in companies within the European Union.
    These GTC apply exclusively. Any conflicting terms from the client are expressly rejected, unless agreed to in writing.
  1. Conclusion of Contract

    All offers from world4europe are non-binding. A contract is concluded either through written acceptance of the offer, through commissioning, or at the latest upon actual use of the services by the client.
    Changes to company details or other material information must be communicated in writing by both parties without delay — especially in the event of loss of official approvals.
  1. Scope of Services

    As part of its international recruitment services, world4europe identifies and places suitable candidates for long-term employment with the client.
    The pre-selection is based on written criteria defined by the client. The final hiring decision is the client’s sole responsibility.
    Information about candidates is based on data provided by the candidates themselves or by third parties (e.g., previous employers). world4europe does not guarantee the accuracy or completeness of this information, nor the authenticity of submitted documents.
  1. Fees

    The placement fee is based on the individually agreed offer or the written order confirmation.
    If no explicit offer exists, a customary and reasonable fee is deemed agreed — with a minimum of €4,000 (net) per successfully placed professional.
    The calculation is based on the agreed gross annual target salary (including fixed and variable components) for full-time employment.
    All fees are subject to applicable VAT.

    world4europe is entitled to:
    • 30% of the total fee upon assignment
    • 40% upon acceptance of the candidate and signing of the employment contract
    • 30% upon the candidate’s first working day

This also applies if:

    • The contractual relationship with world4europe has ended before the hiring or start date
    • Employment is made via a third party
    • The candidate is hired for a different position than originally planned

A fee is also due if the client establishes an employment relationship — directly or through an affiliated company — within twelve months of the candidate’s first introduction.
The client must promptly inform world4europe of any hiring decision and the agreed annual salary.

Costs for job ads or other additional services requested by the client are billed separately.

  1. Payment Terms

    The fee is payable within eight days of receipt of invoice, without deductions.
    If no written objection is made within this period, the invoice is deemed accepted.
    In the event of late payment, world4europe may charge 1.5% interest per month, as well as debt collection and legal costs.
    In case of payment default, world4europe is entitled to suspend its services and invoice all outstanding amounts in a lump sum.
  1. Non-Solicitation Clause

    Both parties agree not to solicit or hire each other’s internal employees — including those from affiliated companies — during the contract period and for six months thereafter.
    In the event of a violation, a contractual penalty of €15,000 per person applies.
  1. Termination

    An individual recruitment order can be terminated by either party with three months’ notice.
    Costs incurred up to that point (e.g., advertising or pre-selection expenses) must be fully reimbursed by the client.
  1. Liability

    world4europe undertakes to carefully select candidates based on client specifications.
    However, the final review and hiring decision lies with the client.
    world4europe accepts no liability for selection errors, candidate suitability, or work/residency permits, unless caused by willful misconduct or gross negligence.
    Liability is limited to the agreed fee per position.
    Claims for lost profits, indirect damages, or consequential damages are excluded — except for personal injury.
    All damages must be reported in writing within five working days and asserted legally within three months.
  1. Data Protection & Confidentiality

    Upon receiving personal data, the client becomes the data controller under the GDPR.
    Such data may only be used for recruitment and employment purposes and must not be disclosed to third parties.
    Candidate data must be deleted or blocked after the selection process concludes.
    The client agrees to receive electronic communication and invoicing from world4europe and may withdraw this consent at any time via email to office@world4europe.com.
  1. Equal Opportunity

    Both world4europe and the client commit to equal treatment of all candidates — regardless of gender, ethnicity, religion, age, sexual orientation, or disability.
  1. Sanctions & Compliance

    The client confirms that neither they, their affiliated companies, nor their representatives are currently subject to sanctions or proceedings.
    The client also agrees not to engage in activities that would violate international trade or financial sanctions.
  1. Time Tracking

    If time tracking is required for the project, the client must ensure this is provided in an electronically processable format to world4europe.
  1. Additional Efforts

    Extra services beyond the agreed contract scope — such as manual data entry or custom evaluations — will be billed separately at an agreed hourly rate.
  1. Final Provisions

    Offsetting claims against world4europe is only permitted if those claims are undisputed or legally established.
    The place of jurisdiction is the competent court in Vienna, Austria.
    Austrian law applies exclusively, without reference to international conflict-of-law rules.
    If any provision in these GTC is deemed invalid, the remaining provisions remain in effect.
    Amendments or additions must be made in writing.
